Probate and Deceased Estates

Probate is the process of proving and registering in the Supreme Court of NSW, the last will of a deceased person. When a person dies, somebody has to deal with their estate.

It is usually the executor named in the will who administers the estate and handles the disposal of the assets and debts. In order for the executor to get authority to do this, they usually need to obtain a legal document called a “Grant of Probate”.

Once this takes place, the executor can proceed to administer the estate.This may involve transferring property to beneficiaries,selling real estate and dealing with shares,money in the bank and other assets of the deceased.
